Consent to Electronic Delivery

Version 3 · effective on acceptance

This consent lets HypeStrat Markets LLC (the “Firm”) deliver your account documents to you electronically instead of on paper. Federal law requires the Firm to tell you what follows before you consent (15 U.S.C. 7001(c); CFTC Regulation 1.33(g)). Please read it before you accept it on the application page. You do not have to consent. If you do not, the Firm will send your documents on paper at no charge.

1What this consent covers

1.1This consent covers all of the following documents for as long as you have an account with the Firm, not only a single transaction:

(a)Confirmations of each transaction, sent not later than the next business day (CFTC Regulation 1.33(b));

(b)Monthly account statements (CFTC Regulation 1.33(a));

(c)Margin notices and other notices about your account;

(d)The Risk Disclosure Statement and other disclosures, the Firm’s Disclosure Document, and updates to them;

(e)Privacy notices (17 CFR Part 160);

(f)The Customer Agreement and the other Account Documents, and any changes to them;

(g)Tax documents, only where you give the separate consent the tax rules require; and

(h)Any other notice or document the law requires the Firm to give you, or that the Firm chooses to give you.

1.2The Firm may still send a document on paper where the law requires it or where the Firm chooses to.

2How documents are delivered

2.1The Firm will post each document as a PDF in the secure document area of your account at the Firm’s website, and will send an email to your email address of record saying that a document is available, with a link to the account site.

2.2A document is delivered when it is posted and the email is sent, whether or not you open it.

2.3Documents stay available in your account for at least the period the law requires, and copies are available on request after your account is closed.

3How long this consent lasts

This consent takes effect when you sign it and lasts indefinitely, until you withdraw it under section 6 or your account is closed and every document due to you has been delivered.

4Charges

The Firm does not charge for electronic delivery. Your internet or mobile provider may charge you for data.

5Paper copies

5.1You may ask for a paper copy of any document delivered electronically, at any time, by email to the contact address the Firm gives you, by secure message in your account, or by writing to the Firm at the contact address the Firm gives you.

5.2The Firm will mail the paper copy within five business days at no charge.

5.3Asking for a paper copy does not withdraw your consent.

6How to withdraw your consent

6.1You may withdraw this consent at any time, without charge, by any of the means in section 5.1.

6.2A withdrawal takes effect within three business days after the Firm receives it. Documents delivered electronically before then remain validly delivered (15 U.S.C. 7001(c)(4)).

6.3After you withdraw, the Firm will send your documents on paper to your mailing address at no charge.

6.4Withdrawing your consent does not close your account.

7Hardware and software you need

To receive, open and keep documents electronically you need:

(a)A computer, tablet or phone with internet access;

(b)A current version of a widely used web browser, with JavaScript and cookies enabled for the account site;

(c)Software that opens PDF files, such as a PDF reader or a browser’s built-in viewer;

(d)An email account that can receive messages from the Firm; and

(e)Enough storage to save documents, or a printer to print them.

If the Firm changes these requirements in a way that creates a material risk that you cannot open or keep a later document, it will tell you the new requirements and that you may withdraw your consent without charge and without any condition or consequence not described here, and it will ask you to confirm your consent again (15 U.S.C. 7001(c)(1)(D)).

8Confirming that you can open documents

Your statements and confirmations are PDF documents. Accept this consent only if your device can open PDF files, as section 7(c) describes. If it cannot, do not consent, and the Firm will send your documents on paper.

9Keeping your email address current

9.1You must keep your email address of record current. You can update it in your account or by secure message.

9.2If an email to you is returned undeliverable, the Firm will try to reach you by other means and may send documents on paper until you give a working address. Documents posted to your account remain delivered.

10Records the Firm keeps

The Firm keeps a copy of every statement and confirmation it delivers, and a daily confirmation statement for your account as of the end of each trading session, for the periods CFTC Regulation 1.31 requires (CFTC Regulation 1.33(e) and (g)(4)).

Your consent

By accepting this consent, I confirm that I have read this disclosure; that my device can open PDF documents; and that I consent to receive the documents described above electronically for as long as I have an account, until I withdraw this consent.

You accept this document electronically on the application page. The version you accepted and the time are recorded.
